Terms of Service

1. Agreement to Terms

By accessing or using the website, platform, or services (collectively, the “Services”) provided by CostCast Inc. (“CostCast,” “we,” “us,” or “our”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. Eligibility

You must be at least 18 years of age and capable of forming a binding contract. By using the Services, you represent and warrant that you meet these requirements.

3. Description of Services

CostCast provides AI-powered claims analytics, reserve prediction, and related technology services for workers’ compensation programs, as well as informational content through its website. The specific scope and limitations of services provided to business customers are governed by separate Customer Agreements, which control in the event of any conflict with these Terms.

4. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to notify us promptly of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable law.
  • Interfere with, disrupt, or compromise the security or integrity of the Services or related systems.
  • Attempt to gain unauthorized access to any part of the Services or other accounts.
  • Reverse engineer, decompile, or otherwise attempt to derive source code or underlying algorithms.
  • Transmit malware, spam, or harmful or deceptive content through the Services.
  • Scrape, crawl, or use automated means to access the Services without prior written consent.
  • Remove or obscure proprietary notices, labels, or marks.
  • Infringe upon the intellectual property or privacy rights of any third party.
  • Resell, sublicense, or redistribute the Services without prior written consent.

6. Intellectual Property

All content, software, technology, trademarks, and materials associated with the Services are owned by or licensed to CostCast and protected by applicable intellectual property laws. These Terms grant you no right, title, or interest in the Services or our intellectual property beyond the limited right to use the Services as permitted. Feedback or suggestions you provide may be used by us without obligation or compensation.

7. User Content

You retain ownership of content you submit through the Services (“User Content”). By submitting User Content, you grant CostCast a non-exclusive, worldwide, royalty-free license to use, process, store, and display such content solely as necessary to provide and improve the Services. You represent that you have all necessary rights to grant this license.

8. Third-Party Links and Services

The Services may link to or integrate with third-party websites or services. We do not control and are not responsible for the content, practices, or availability of third-party resources. Your use of such resources is at your own risk and subject to their terms.

9. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. CostCast does not warrant that the Services will be uninterrupted, error-free, or secure.

The Services include AI-assisted features. AI outputs are provided for informational and operational support and should not be relied upon as the sole basis for decisions with legal, financial, or medical consequences without appropriate human review.

10. Limitation of Liability

To the maximum extent permitted by law, CostCast and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services, regardless of the legal theory.

CostCast’s total aggregate liability arising out of these Terms or the Services shall not exceed the greater of (a) the amounts you paid to CostCast in the twelve months preceding the claim or (b) one hundred U.S. dollars ($100.00). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless CostCast and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Disputes arising from these Terms or the Services shall be resolved exclusively in state or federal courts in Delaware, and you consent to their personal jurisdiction. To the extent permitted by law, you waive any right to a jury trial and agree that claims must be brought individually, not as part of a class or representative action.

14. Modifications

We may modify these Terms at any time. Material changes will be posted on this page with an updated date. Continued use of the Services after changes constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will continue in full effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any applicable Customer Agreement, constitute the entire agreement between you and CostCast regarding the Services and supersede all prior agreements. In the event of a conflict between these Terms and a signed Customer Agreement, the Customer Agreement controls.
